Italy: the representativeness of trade unions and employer associations in the banking sector.
Nel settore finanziario italiano operano 11 sindacati e 5 organizzazioni imprenditoriali. Di queste ultime una, l’ABI, è di gran lunga la più rappresentativa. Il settore non ha risentito in modo grave della crisi finanziaria internazionale essendo specializzato in attività di tipo tradizionale che poco dipendono dalle attività finanziarie internazionali più colpite dalla crisi. Quasi il 34% del mercato bancario italiano è occupato da due grandi gruppi, frutto di fusioni avvenute a metà degli anni Duemila. Il settore è regolato da quattro ccnl, tre dei quali vengono applicati dalla stragrande maggioranza delle imprese. La contrattazione si tiene principalmente a livello centrale/nazionale.
1. Sectoral properties
Il settore bancario considerato in questo studio è stato definito sulla base del codice Nace 64, che comprende tutte le attività finanziarie. Dallo studio sono state escluse le attività relative alla banca centrale (64.11)
Economic background
Il settore delle attività finanziarie italiano, soprattutto per quanto riguarda le banche, ha una struttura particolare rispetto agli altri paesi europei. E’ specializzato, infatti, in attività di tipo tradizionale, meno dipendente dai mercati e strettamente regolato e vigilato dalla Banca d’Italia. Queste caratteristica, insieme alla bassa presenza nei bilanci delle banche delle attività finanziare colpite dalla crisi, hanno limitato l’impatto della crisi finanziaria internazionale, iniziata nell’estate del 2007. Conseguentemente, la crisi non ha avuto un profondo impatto sui livelli occupazionali e sulle relazioni industriali del settore.
La crisi ha colpito maggiormente gli intermediari non bancari. Il settore del credito specializzato (leasing, factoring, credito al consumo) ha risentito in maniera maggiore della caduta degli investimenti e dei consumi.
All’interno del sistema finanziario italiano, alla fine del 2008 operavano 799 banche e 81 gruppi. Il numero delle banche alla fine del 2009 è sceso a 788 a seguito di incorporazioni, fusioni o cessioni di attività (in cinque casi). A fine 2009 i gruppi bancari erano 75.
Negli ultimi dieci anni, il sistema bancario italiano è stato oggetto di numerose fusioni, con la costituzione di due grandi gruppi bancari – Intesa Sanpaolo e UniCredit – che occupano il 33,9% delle attività del sistema bancario italiano. Gli altri tre gruppi di dimensioni medio-grandi (Banca Monte dei Paschi di Siena, Banco Popolare e Unione di Banche Italiane) occupano il 18,6% del sistema. Il 35% del sistema è occupato da 51 gruppi e banche individuali di dimensione medio-piccola mentre 590 piccoli intermediari che operano prevalentemente a livello locale occupano il 12,5% del mercato (Banca d’Italia, Relazione annuale sul 2009, http://www.bancaditalia.it/pubblicazioni/relann/rel09).

Le organizzazioni di rappresentanza degli imprenditori hanno caratteristiche particolari.
Le organizzazioni che contrattano sono ABI, FEDERCASSE e, per una piccola parte del settore, l’AGCI.
Assopopolari e Acri non stipulano CCNL ma le imprese che fanno riferimento a queste due organizzazioni applicano il ccnl Abi.

No. Nel settore una grandissima parte delle imprese aderisce all’Abi e a Federcasse. C’è, tuttavia, l’Agci che stipula un Ccnl a parte con due organizzazioni sindacali (Silcco e Sinadi) per le banche di credito cooperativo. Le banche che aderiscono all’Agci non sono, tuttavia, numerose.

4. The system of collective bargaining
Nel settore esistono quattro Ccnl applicati dalla stragrande maggioranza delle imprese e un Ccnl rivolto ad una piccola fetta di settore.
4.1. Estimate the sector’s rate of collective bargaining coverage (i.e. the ratio of the number of employees covered by any kind of collective agreement to the total number of employees in the sector).

Il Contratto collettivo nazionale stipulato con le organizzazioni di rappresentanza degli imprenditori (Multi-employer agreements) è più importante dei contratti di secondo livello, stipulati con singole imprese o gruppi (single-employer agreements). Il CCNL stabilisce le normative e l’adeguamento economico. I benefit e gli incrementi retributivi vengono stabiliti dai contratti aziendali.
4.2.1. Is there a practice of extending multi-employer agreements to employers who are not affiliated to the signatory employer associations?
É possibile ma non è frequente. Quasi tutte le imprese sono associate a qualche organizzazione di rappresentanza.
4.2.2. If there is a practice of extending collective agreements, is this practice pervasive or rather limited and exceptional?
I contratti collettivi di lavoro sono regolati dal diritto privato e pertanto dovrebbero impegnare alla loro applicazione solo le aziende ed i lavoratori aderenti alle organizzazioni che li firmano. L’art. 36 della Costituzione italiana sostiene che al lavoratore deve essere garantito un salario “sufficiente ad assicurare a sé e alla famiglia un'esistenza libera e dignitosa” ma l’importo di tale salario non è stabilito per legge. Da oltre 50 anni si è affermata, per tutti i settori, una prassi giurisprudenziale che ha fatto sì che i giudici chiamati ad esprimersi in cause di lavoro abbiano sempre considerato come salario che soddisfa i requisiti previsti dalla Costituzione quello stabilito dai contratti collettivi nazionali stipulati dalle associazioni sindacali ed imprenditoriali maggiormente rappresentative.
Il contratto collettivo nazionale di lavoro, quindi, costituisce de facto la normativa di riferimento per tutti i lavoratori e tutte le aziende del settore. Se un’azienda eroga salari più bassi di quelli stabiliti dal CCNL applicabile al suo settore di riferimento, il lavoratore può fare ricorso alla magistratura e sicuramente ottiene l’applicazione di quanto previsto dal contratto, anche se, spesso, la vertenza gli costa il posto il lavoro. Di solito, infatti, i ricorsi vengono intrapresi dai lavoratori dopo il licenziamento.
Nei fatti, grazie alla prassi giurisprudenziale descritta sopra, da oltre 50 anni il CCNL è applicato a tutti i lavoratori e a tutte le aziende del settore di riferimento, assicurando un potenziale livello di copertura a tutti i lavoratori del settore.

Nel settore l’ultimo CCNL (IT0802029I) ha stabilito che il rinnovo della la parte economica sarà effettuato insieme al rinnovo della parte normativa ogni tre anni. Non c’è, quindi, come avveniva precedentemente, una contrattazione economica a parte a due anni dalla stipula del CCNL.

Nel periodo 1998-2007 le parti firmatarie dei più importanti Ccnl hanno giocato un ruolo importante nella gestione e regolamentazione delle grandi ristrutturazioni e fusioni avvenute nel settore (IT0609029I, IT0706019I),. In quel periodo sono stati stipulati due importanti accordi concertativi, uno nel 1997 (IT9706115N) per la gestione delle ristrutturazioni e uno nel 2004 (IT0408104N) per la responsabilità sociale delle imprese (Corporate social responsibility).

Per i sindacati, il numero di iscritti ed i risultati delle elezioni per le Rappresentanze Sindacali Unitarie RSU o il numero di Rappresentanze Sindacali Aziendali RSA nei luoghi di lavoro danno modo di definire il grado di rappresentatività di ciascuna organizzazione nell’ambito delle loro relazioni, senza che ciò assuma alcun rilievo giuridico.
Alle trattative per il rinnovo dei contratti collettivi possono partecipare tutte le rappresentanze sindacali, anche quelle meno rappresentative. È interesse delle aziende, di solito, far partecipare più organizzazioni possibili per prevenire azioni conflittuali al proprio interno. Le aziende, solitamente, mirano a contrattare con organizzazioni che rappresentino complessivamente almeno il 50% dei lavoratori in azienda.

Non esiste in Italia una legge che stabilisca i criteri per determinare la rappresentatività dei sindacati o delle organizzazioni dei datori di lavoro nel settore privato.
La legge 300/1970 (Statuto dei lavoratori) stabilisce i diritti sindacali dei lavoratori e i diritti e i doveri per i rappresentanti sindacali. Per le organizzazioni sindacali firmatarie dei contratti collettivi nazionali di lavoro, la legge stabilisce, come unico limite alla nomina di un proprio rappresentante sul luogo di lavoro, la soglia dei 15 dipendenti per le imprese industriali e dei 5 dipendenti per le imprese agricole.
Misure aggiuntive in termini di diritti sindacali individuali e collettivi vengono concordate tra le parti nei contratti collettivi nazionali che stabiliscono, fra l’altro, anche i criteri per partecipare agli organismi bilaterali o trilaterali.
Le forme della rappresentanza sono regolate per legge, diritti più estesi sono regolati tramite un accordo interconfederale stipulato nel 1993 e dai singoli contratti di categoria.

Per le organizzazioni di rappresentanza imprenditoriali non esistono organismi che ne stabiliscano il peso rappresentativo. Quest’ultimo viene valutato sulla base del numero di imprese aderenti dichiarato dall’organizzazione.
7. Commentary
La rappresentanza nel settore bancario appare molto regolata, con due grandi organizzazioni imprenditoriali che rappresentano quasi l’intero universo delle imprese e un alto tasso di sindacalizzazione fra i dipendenti, concentrato principalmente sulle nove organizzazioni sindacali firmatarie dei ccnl Abi e Federcasse.
La tradizione unitaria dei sindacati bancari, anche se molti di essi hanno estrazioni ed obiettivi diversi, è di lunga data. La compattezza della rappresentanza dei lavoratori e le caratteristiche economiche del settore hanno favorito, da sempre, una posizione di “privilegio” dei lavoratori bancari nel settore privato, sia per quanto riguarda le tutele e le agevolazioni di cui possono godere, sia per quanto riguarda le retribuzioni.
