MILITARY SERVICE

In Belgium, the 1978 Contracts of Employment Act provides for suspension of the performance of the employment contract by reason of certain events connected with military service. In contrast to other cases of suspension regulated by the Act there is no guaranteed pay in this instance, but a guarantee of job security .

For both blue-collar and white-collar workers, performance of the contract of employment is suspended for the duration of the following events:

1. the military call-up or military recall of an employee;

2. a stay in a recruitment and selection centre;

3. a period spent under observation in an army medical establishment;

4. hospitalization in a military establishment owing to an accident sustained or illness contracted or aggravated during medical examination procedures or selection tests;

5. service in civil defence organizations;

6. re-enlistment that takes effect when the period of compulsory service expires, provided the total duration of compulsory service plus re-enlistment does not exceed two years;

7. performance of the service imposed on conscientious objectors;

8. a period spent by a conscientious objector working in a public health service establishment or in a nursing home.
