Since non-union members employed by the employers bound by a collective agreement are almost always treated fully in accordance with its provisions, trade unions have in the past sought to incorporate in collective agreements the obligation on non-union members to pay to the appropriate union concerned, in place of the union membership subscription they save, a special levy as a contribution towards the costs of union activity.
The imposition of such a levy by collective agreement is held to be unlawful, since an agreement between the parties to a collective agreement to oblige third parties to pay levies is not covered by collective bargaining autonomy , which as a matter of principle encompasses only members of the organizations concluding the agreement.
