Military service, which is compulsory in Portugal, may have effects in the sphere of employment relationships insofar as it makes it impossible for the employee to supply the work performance. Article 276(7) of the Constitution establishes the general principle that the performance of compulsory military service or alternative community service shall not prejudice the citizen's position at work or permanence of employment. In accordance with this principle, labour legislation (Article 3(1), Suspension of the Employment Contract Act) includes compulsory military service among the reasons for suspension of the contract of employment , thereby ensuring that employees who are conscripted have their jobs preserved for them.
