Work performed for third parties in which the person performing the work is in a position of autonomy, i.e . organizes and directs its performance themselves. The concept acquires significance in contradistinction to work performed as an employee in a position of subordination to another's authority ("trabalho subordinado" or "trabalho heterodeterminado"), in which the performance of work is directed and organized by the party to whom it is due. This contradistinction is recognized in Portuguese legislation through the distinction made by the Civil Code between a contract for services and a contract of employment . The importance of this distinction essentially lies in operating as the means of delimiting the subject of labour law and thereby governing the application of labour legislation.
