TRAINING CONTRACT

Decree-Law No. 242 of July 7, 1988 established the rights and obligations of trainees on vocational training courses subsidized by public funds, expressly excluding from its coverage trainees bound to the employer providing training or to third parties by a contract of employment or any public-law legal bond relating to employment. The employer and trainee are bound by a training contract, which must be in written form, does not give rise to a relationship of subordination and lapses when the stipulated training is completed. The primary obligations of the employer are: to provide the intended training, and to issue a document attesting to the trainee's completion of the training, its duration and the improvement achieved. In addition, the employer is prohibited from making use of trainees to meet normal or temporary labour requirements.
