REDUNDANCY PROCEDURE

Procedure which must be followed when a contract of employment is to be terminated or suspended for economic or technological reasons or on grounds of force majeure. In Spain, such action requires the agreement of the workers' representatives or, failing this, prior official authorization. It is also called the expediente de crisis (crisis procedure) or simply regulación de empleo (adjustment of employment). This formula, which is particularly important in the case of collective dismissal/redundancy , has a long tradition in Spanish labour legislation and is accepted by the trade unions. In 1994 the legislation was reformed to bring it into line with EEC Directive No.129/1975, although the requirement for official authorization has been retained. In the past few years there has been a slight increase in instances of redundancy and in the number of employees affected. See dismissal for objective reasons .
