INDUSTRIAL ACTION TO RECOVER UNPAID WAGES

INDUSTRIAL ACTION TO RECOVER UNPAID WAGES

Expression used to refer to industrial action by the employee side directed at recovering outstanding pay from the employer. If pay which is due to them is not paid, the employees affected can stop work and sometimes even resign without notice (see cancellation of the employment contract). In addition, in order to induce the employer to pay the employees concerned their union can organize action to cut off the employer's business from access to labour and supplies of materials, etc. (see cancellation of the employment contract) as a means of making its continued operation impossible. Under the 1976 Co-Determination Act, it is lawful to take such action to recover pay that is manifestly owed even while a collective agreement is in force. Although it was at one time of practical importance, particularly in the building industry, the need for action of this kind has decreased since the state-organized system of pay guarantee in the event of the employer's bankruptcy was introduced in 1970.
