DISPUTE RESOLUTION

Generic term for methods of resolving disputes in the labour market. In Sweden it has always been voluntary in the sense that there are no statutory rules on compulsory dispute settlement under state control: cf. mediation. However, both collective agreements and individual contracts of employment can contain clauses whereby the parties undertake to accept binding dispute settlement (see arbitration). The unions and employers' organizations have used varying approaches to the creation of settlement mechanisms in order to prevent disputes from escalating into outright conflict or being left unresolved and hence a continuing source of irritation and an obstacle to co-operation. A fundamental distinction is made in this respect between disputes of interest and disputes of rights.
