ATTACHMENT OF EARNINGS

In accordance with Austrian law, the remuneration due to an employee under a contract of employment is subject to seizure (Pfändung) only above certain exempted amounts. These amounts include, in particular, the minimum subsistence level, which is based on the income support threshold (Ausgleichszulagenrichtsatz), plus an additional sum for each eligible dependant. Above a specified threshold, net earnings are fully attachable. Separate rules apply as regards special allowances. The attachment of earnings is initiated by the issue of a court order of execution to the employer prohibiting, with immediate effect, the payment to the employee of that proportion of the wage or salary which exceeds the exempted amounts. The resultant sum must be paid to the creditor who has sued for payment, until the debt in question has been cleared.
