|CO-OPERATION IN GOOD FAITH
According to Article 39(1) of the Labour Constitution Act (Arbeitsverfassungsgesetz), the purpose of the works constitution is to form the basis for reconciling the interests of employees and the establishment. This gives rise to a requirement for co-operation on the part of both works council and management within the framework of co-determination at establishment level. In addition, in the context of this statutory provision the works council is under an obligation to perform its function of interest representation in conjunction with the Chambers of Labour and those trade unions which possess the capacity to conclude collective agreements. It has the right to consult these organizations on all matters.
