Term denoting the special obligation to safeguard interests which is incumbent on the employee with respect to the employer. It does not concern an inner attitude, but a duty to observe a correct mode of conduct in the employer's service. This obligation to safeguard the employer's interests implies, in particular, a duty to refrain from various forms of action such as entering into competition (see trade secret), divulging trade or business secrets (see trade secret), accepting bribes or defaming the employer's company or products. However, there is also a derived duty to engage in certain forms of action such as informing the employer of any impending threat, working extra hours if disproportionate damage could otherwise ensue or doing emergency work under similar circumstances.
