Under Article 94 of the Labour Constitution Act (Arbeitsverfassungsgesetz), the works council is granted consultation rights on matters relating to in-service training and further training. The employer is thereby obliged not only to inform the council of any planned measures on training and further training but also to ask for its proposals on such measures. The council also has the right to collaborate in the development of the measures concerned and in the management of the resultant company arrangements. Any such issues, including the introduction, alteration or discontinuation of provisions for training and further training, may be the subject of a works agreement. In the event of failure to conclude a works agreement, either of the two parties can call on a mediation and arbitration board (Schlichtungsstelle) to decide the matter.
