JOINT COLLECTIVE-AGREEMENT COMMITTEE

In Portugal, a collective agreement must provide for the formation of a committee made up of an equal number of representatives of each of the signatory parties, which is empowered to interpret (and perhaps supplement) the agreement's provisions (Article 41(1), Collective Labour Relations Act). Unanimous decisions issued by these committees are deemed to constitute, in all effects, regulation of the collective instrument to which they relate, and they are deposited and published in accordance with the same procedure as collective agreements. These unanimous decisions are also automatically applicable to employers and employees included in the coverage of the agreements concerned by virtue of extension directives . The above-mentioned effects do not apply where decisions are not unanimous.
