|MINIMUM CONDITIONS OF EMPLOYMENT
No blanket-coverage system of generally binding minimum terms and conditions of employment is laid down by law in Austria. This is particularly true in the case of wages and salaries, for which the prevailing principle is that they are agreed freely: according to the Civil Code, a presumption of fair remuneration applies only where no rate of pay is specified in the contract and it has not been agreed that the work is unpaid. This statement needs to be qualified, however, to the extent that the minimum pay and other conditions laid down by collective agreements, which must be observed by the parties to individual contracts of employment bound by a given agreement, guarantee a “floor” of social standards.
