PREVENTION OF OCCUPATIONAL HAZARDS ACT

Law of November 8, 1995 which establishes the general framework of health and safety at work. It regulates, among other matters: the general obligations or duties of employers, employees and the manufacturers and suppliers of machinery and equipment in regard to the prevention of risk; the consultation and participation rights of employee representatives ( safety representatives ) regarding decisions that affect this aspect of labour relations; rules on the composition and functioning of the new health and safety committee ; the relevant powers of the public authorities; and the schedule of offences and administrative sanctions laid down for the enforcement of general and particular obligations connected with health and safety at work. The Act stipulates that specific health and safety measures are to be laid down by official regulations; as a general principle, the preventive measures previously laid down in the General Ordinance on Heath and Safety at Work and other regulatory provisions are to remain provisionally in force until such time as these new regulations are issued.
