Although the labour law provisions on employee protection essentially apply equally to both men and women, the Austrian legislators have provided for a number of bans and restrictions in the case of women concerning activities that may involve a special risk for them. Furthermore, there is still a statutory ban in force on night work (work between 2000 and 0600 hrs) for women, although this has been eased by a number of permitted exceptions and the parties to collective bargaining are entitled to introduce additional ones. This national provision must, however, be adapted by the year 2001 at the latest to the case-law of the European Court of Justice, which deems a specific ban on work by women to be unlawful. In addition, there are comprehensive maternity protection regulations in force to protect women during pregnancy and the post-confinement period (see employee protection: protection regulating the employment of particular groups).
