Employers are subject to restrictions with regard to the introduction and use of staff questionnaires. Any employer wishing to introduce questionnaires with a content which extends beyond general personal particulars and information on occupational requirements for the type of work to which the employee is to be assigned needs the prior consent of the works council. This consent must be in the form of a mandatory works agreement (see works agreement, works constitution: rights and responsibilities of the works council).
