TEMPORARY-EMPLOYMENT AGENCY WORK

Contract of employment whereby an employee who is hired and paid by one enterprise is placed at the disposal of a different employer, called the user, who receives his or her work performance. The employment relationship established in this way is therefore characterized by the presence of three actors and by the dissociation between the identity of the employing party to the contract of employment and the actual use of the performance. This form of employment, already used extensively in some European countries, is prohibited in Italy under Law No. 1369/60 (see contracting and subcontracting ). In recent times, however, a widespread debate has opened up on the advisability of introducing it. In the Agreement of 23 July 1993 , in particular, the parties recognize the need to regulate it "in order to make the labour market more efficient"and establish a number of limits and forms of protection for the workers to whom any implementing legislation would apply.
