Term denoting the period set in an expiry clause (Verfallsklausel), i.e. a clause stipulating that the claim to which it relates will lapse if it has not been asserted by the time that period expires. Expiry clauses are often laid down in collective agreements. The courts hold such clauses to be null and void in cases where, by setting an unreasonably short time limit, they make the assertion of claims disproportionately difficult without objective justification and are hence deemed to be contra bonos mores or in contravention of mandatory legal provisions on the time limit for asserting claims, to the employee's disadvantage. (The terms Ausschlussfrist and Präklusivfrist are used synonymously.)
