Justice declares that Deliveroo's 'riders' are subject to an employment relationship with the company (La Justicia declara que los ‘riders’ de Deliveroo están sujetos a una relación laboral con la empresa)

The Social Court No. 19 of Madrid has estimated the lawsuit filed by the General Treasury of Social Security against Roodfoods Spain SL ('Deliveroo') and declares that the plaintiffs (food delivery people at home, commonly known as 'riders' ) were subject to an employment relationship with the defendant company at the time they rendered their services. The magistrate concludes that during the period in which the distributors were linked to the defendant society ‘the conditions of work prevailed.’ Among other legal reasoning, it is considered proven that 'once the order was accepted, it had to be attended (by the deliverymen) in accordance with the detailed instructions determined by the company, with no appreciable margin of autonomy for the worker'.

Spanish: El Juzgado de lo Social nº 19 de Madrid ha estimado la demanda interpuesta por la Tesorería General de la Seguridad Social contra Roodfoods Spain S. L. (‘Deliveroo’) y declara que los trabajadores demandantes (repartidores de comida a domicilio, comúnmente conocidos como ‘riders’) estaban sujetos a una relación laboral con la sociedad demandada en el tiempo en que prestaron sus servicios. El magistrado concluye que durante el periodo en que los repartidores estuvieron vinculados a la sociedad demandada ‘prevalecieron las condiciones propias de la laboralidad’. Entre otros razonamientos jurídicos, se considera acreditado que ‘una vez aceptado el pedido, el mismo había de atenderse (por parte de los repartidores) de acuerdo con las detalladas instrucciones determinadas por la empresa, sin margen apreciable de autonomía del trabajador’
