Tackling undeclared work database

Undeclared work can be defined as work which is in itself legal but is not declared to the authorities for tax, social security and/or labour law purposes. Across the 28 Member States of the European Union, a great deal of effort is being invested into developing and testing policy measures that aim to tackle undeclared work.

Network Services project, Italy

  This initiative was implemented in 2011–2012 with a view to preventing undeclared work in the Italian ‘convergence’ regions of Calabria, Campania, Puglia and Sicily. It involved a traineeship programme targeted at Italian and European citizens in the construction, tourism and agriculture sectors who were unemployed or inactive. The project provided some 1,700 two-month traineeships aimed at enhancing job prospects and promoting skills acquisition.

Inspection strategy in agriculture and construction, Italy

  In 2010, the Italian Ministry of Labour launched a special inspection strategy to fight undeclared work in agriculture and construction in four southern Italian regions. The project aimed to introduce an integrated and targeted inspection system to improve the effectiveness of controls and increase detection rates.   Background On 28 January 2010, the Italian government launched a special inspection strategy in the agriculture and construction sectors in the regions of Calabria, Campania, Puglia and Sicily to fight undeclared work.

Tool to measure labour costs in construction, Italy

  The social partners in the construction sector defined a set of ‘appropriateness’ parameters in October 2010 to be used to assess the regularity of firms in terms of the incidence of labour on total costs. The parameters are designed to promote the regularisation of undeclared work. At present, an experimental phase is still under way.

  In 2001, the government passed a law promoting the regularisation of employment through the provision of substantial incentives. The government’s move was based on the assumption that undeclared work existed due to the high level of taxes and contributions to be paid. The law targeted companies, workers and employers throughout the country. The principal objectives were to enhance social security services for workers, improve tax compliance, combat unfair competition, and reduce the level of undeclared work.

Realignment contracts, Italy

  The 1990 law on realignment contracts provided for trade unions and employer organisations in the south of Italy to agree on a minimum wage at provincial level (no less than 25% of the national minimum wage and adjusted within three years to 100% of the national minimum wage). It aimed at reducing the burden of tax and social contributions for employers and workers during that period, while not penalising past non-compliance in terms of tax, workplace safety and social welfare contributions.

Combating undeclared work and promoting safety in construction, Italy

To combat undeclared work and improve workplace safety in the building industry, Article 36bis of Law No. 248/2006 introduced ‘Urgent measures to fight undeclared labour and to promote safety measures in workplaces’. A number of sanctions can be applied to employers found to be using undeclared labour.

A new measure encourages the regularisation of undeclared work by increasing inspection activity, suspending work to companies using irregular work, and issuing administrative and civil sanctions. The legislation aims to regulate the occupational status of workers with regard to pay and social insurance contributions, and to regularise the position of immigrant workers without stay permits but employed on construction sites.

  The Urban Operational Centres for Economic Renewal (Centri Urbani Operativi per la Riqualificazione Economica, CUORE) project consists of a network of neighbourhood service centres for entrepreneurs and potential entrepreneurs. The primary objective is to develop a friendly relationship between the state and informal entrepreneurs, with the government offering help but expecting something in return.

Reform of inspection services, Italy

  • Italy
Decree Law No. 124 of 23 April 2004 introduced reform of the labour inspection services. The aims were to improve coordination and information exchange between the various agencies involved, and to move beyond the traditional penalty based approach by also offering advisory services.
