Description

On 11 April 2018, the district court of Pennsylvania granted summary judgement on the matter of whether drivers for UberBlack are independent contractors or employees. The plaintiffs brought individual and representative claims against Uber of alleged violations of the federal minimum wage and overtime requirements under the Fair Labor Standards Act and Pennsylvania state laws. They requested, among others, back pay for overtime. The judge ruled in favour of Uber on the basis that the plaintiffs had not met their burden to show that they were employees of Uber.
