Uber law: labour law perspectives on the sharing/ on-demand economy (Uber law: prospettive giuslavoristische sulla sharing/on-demand economy)

The spread of on-demand work is a phenomenon of great complexity, which is part of the more general framework of the transformation of labour. It represents a key element, being at the same time cause and consequence of the important changes that are occurring. The definition of on-demand workers includes actors involved in two different dynamics, namely: the emergence of online applications and platforms, where the demand and supply of goods and services meet; and the increasingly massive use of zero hours contracts, namely – in brief, and beyond the important differences between the different jurisdictions - those contractual forms in which no minimum working time is guaranteed to the workers (in some contexts, such as in the English case).

Italian: La diffusione del lavoro on-demand è un fenomeno di grande complessità, che si inserisce nel piùgenerale quadro della trasformazione del lavoro, quale elemento altamente caratterizzante, almomento stesso come conseguenza e come causa degli importanti cambiamenti in atto. Sotto la definizione di lavoratori on-demand si possono fare rientrare i soggetti coinvolti in duedifferenti dinamiche: la nascita di applicazioni e piattaforme online di incontro tra domanda edofferta di beni e servizi; l’utilizzo sempre più massiccio in alcuni contesti (è il caso inglese) deicontratti a zero ore, cioè – generalizzando al di là delle importanti differenze tra i diversiordinamenti – di quelle forme contrattuali in cui non si preveda un orario minimo garantito allavoratore.
