Germany: Long serving staff should be granted longer periods of notice says court
Workers who have been with companies for an extended period of time should be given longer notice periods says a German court.
The German Federal Labour Court affirmed the principle according to which ‘in the case of planned dismissal longer legal periods of notice apply for employees with long tenure’.
The court decided that this does not constitute indirect age discrimination. Even though the practice may in some cases possibly discriminate against younger employees, it is justified by the aim of giving older employees better dismissal protection.
