France: Stricter rules on posting of workers

On 30 March 2015, a government decree, pursuant to recent legislation, introduced stricter rules on the posting of workers. Foreign employers now have to nominate a legal representative in France, and the main contractor using the services of a foreign company has more responsibilities to comply with local legislation. In February, the Minister of Labour announced that tackling illegal work [in French] would be a priority of his in 2015. Accordingly, the government wants to fight fraudulent posting of workers, strengthen control mechanisms, and develop preventive actions. Illegal work is by far the most significant infringement of labour law that labour inspectors encounter.

At the same time, posting of workers to France continues to increase. According to a report analysing posting declarations by service providers (1.3 MB PDF, in French) from the Ministry of Labour’s Directorate-General for Labour Affairs (DGT), some 67,000 posting declarations were issued in 2013 for 7.4 million days worked or 32,000 full-time equivalents. In comparison to the previous year, the figure corresponds to an increase of 12% in terms of declarations and a 30% increase in terms of the number of days worked.
