Nos últimos anos, para além de alguns picos intermitentes, tem havido uma diminuição geral das ações coletivas em todos os Estados-Membros da UE. Durante a pandemia de COVID-19, esta tendência manteve-se, tendo os conflitos laborais mais significativos ocorrido, sem surpresa, no setor da saúde humana e nos serviços sociais, no setor da educação e no setor dos transportes e logística. Este relatório analisa os dados recolhidos em 2018-2019, pela Eurofound, durante a fase piloto da sua base de dados «Industrial Action Monitor» (IAM). Recorrendo à análise de grupos, a investigação classificou as ações coletivas na Europa em cinco categorias: conflitos nacionais de interesses e direitos, por vezes envolvendo diferentes formas de emprego; conflitos alargados sobre convenções coletivas de trabalho; conflitos localizados sobre problemas de emprego, tempo de trabalho e reestruturações, com paragens de trabalho curtas; conflitos localizados sobre direitos e queixas dos trabalhadores sobre políticas empresariais; e conflitos relativos a políticas públicas.
Em termos de questões específicas, os problemas relacionados com a remuneração representaram mais de 40 % dos conflitos, os problemas relacionados com o emprego representaram 20 %, outros aspetos em matéria de condições de trabalho representaram 16 % e os protestos representaram 13 %. Notando a falta de dados completos sobre as ações coletivas na Europa, a análise aponta para a necessidade de uma recolha sistemática de provas empíricas no futuro, a fim de disponibilizar uma base sólida para análise comparativa.
Key findings
A negociação coletiva foi o contexto de mais de um terço dos conflitos na UE, com queixas sobre as políticas ao nível da empresa a representarem 25 % e queixas sobre políticas públicas a representarem outros 18 %.
Os problemas relacionados com a remuneração representaram mais de 40 % dos conflitos, os problemas relacionados com o emprego representaram 20 %, outros aspetos em matéria de condições de trabalho representaram 16 % e os protestos representaram 13 %. Mais de 80 % dos conflitos foram respeitantes a questões de interesse.
Os dados existentes sobre ação coletiva na Europa são incompletos. A recolha sistemática será necessária para proporcionar uma base para análise comparativa assente em definições claras acordadas a nível internacional, para que possam ser coligidos com outros dados a fim de permitir o cálculo dos custos económicos dos conflitos, para empregadores e trabalhadores.
Os conflitos na UE enquadram-se em cinco grupos principais usados na tipologia: conflitos de interesse e direitos nacionais; conflitos de interesse alargados relativos a acordos (salariais) coletivos; conflitos localizados sobre questões de interesse, relativos a problemas de emprego, tempo de trabalho e reestruturação com curtas interrupções laborais; conflitos localizados respeitantes a direitos dos trabalhadores e queixas sobre as políticas da empresa; conflitos respeitantes a políticas públicas.
A distribuição destes tipos entre países não seguiu nenhum dos padrões que poderiam ser esperados com base em cinco das tipologias existentes na literatura: tipologias baseadas em diferenças nacionais nas variedades de capitalismo, densidade sindical, intensidade da atividade grevista, tipos de democracia industrial e negociação coletiva.
