Theme 3: The company level social dialogue - New developments

The European Commission followed up the works (implementation reports) in the context of the review of the framework directive on workplace information and consultation with a fitness check, to see if the EU directives providing workplace information and consultation are fit for purpose. In 2012, the European Commission issued a Green Paper and a 300-page Commission staff working document on restructuring and anticipation of change.

Eurofound also developed research on information and consultation practices in Europe. In the context of the foreseen review of the 2002/14/EC framework directive on information and consultation, another Eurofound study mapped the experiences five years after the adoption of this directive. More recently, the European Parliament called for a new EU legal act on restructuring. In this context, the report of MEP Alejandro Cercas is a document that might open opportunities for new legal framework developments of European industrial relations. Also the area of the International and European framework agreements still lacks a supportive legal framework. The key issues for employers are presented in a Business Europe report. The trade unions views on worker participation are well documented on a specific website dedicated to this aspect of industrial relations. The European Restructuring Monitor provides information on the impacts of restructuring on employment.
