IAU fined following airport strike

According to the judgment, the union breached its peace obligation. According to IAU, the strike was a protest expressing concern about airport safety and the personnel policy of the Finnair airline.

On 3 November 2000, an arbitration tribunal gave its judgment in a dispute over a protest strike organised by the Finnish Air Transport Union (Ilmailualan Unioni, IAU), representing airport workers, which stopped all domestic flights for a period on 1 November (FI0011166N). The arbitration procedure was based on the sector's collective agreement.

The six-hour stoppage organised by IAU in protest against planned structural changes at the Finnair airline was condemned as illegal by the arbitration tribunal. According to the judgment, the union had contravened the relevant collective agreement's peace obligation. IAU was ordered to pay a fine of FIM 25,000 in compensation, plus FIM 8,000 towards the legal expenses of the Association of Support Service Industries (Palvelualojen Toimialaliitto), which brought the case. The arbitration tribunal held that pressure was put on the employer through strike action in order to achieve a solution in areas which belonged within the remit of the employer's responsibility and decision-making powers.

According to IAU, the strike was a protest expressing concern about air safety and the personnel policy of Finnair. The union considers the judgment as showing that the "right to manage" of the employer goes beyond the provisions of the air safety legislation. On these grounds, it requires that the relationship between air safety officials and the air traffic business be examined as soon as possible. IAU has announced that it dissociates itself from the structural changes planned by Finnair and from any cooperation projects other than those expressly provided for in agreements with the company.
