Working time agreement signed for private bus drivers

A new collective agreement signed in June 2002 in Luxembourg's private bus transport sector provides that drivers will receive at least seven hours' pay for an 11-hour daily period of availability to work. Previously, they were paid only for hours actually worked.

After negotiations extending over many years, a government proposal to reduce the daily 'duty time' (amplitude journalière) of private sector bus drivers from 12 to 11 hours was accepted by the trade unions in July 1998 (LU9807169N). This duty time includes all the periods when drivers are at the employer's disposal: driving; waiting for the next journey to begin; making preparations; or taking rest periods in accordance with national and EU law

Since 1998, there have been long and painful negotiations on the implications of the new system. These were finally concluded on 4 June 2002 by a new collective agreement on the issue. The deal was signed by three transport sector trade unions: the Christian Transport Workers' Federation (Fédération Chrétienne du Personnel du Transport, FCPT) affiliated to the Luxembourg Confederation of Christian Trade Unions (Lëtzebuerger Chrëschtleche Gewerkschafts-Bond, LCGB); the Association of Luxembourg Drivers (Association des conducteurs d'automobile du grand-duché de Luxembourg, ACAL) affiliated to the Luxembourg Confederation of Independent Trade Unions (Onofhängege Gewerkschafts-Bond Lëtzebuerg, OGB-L); and the National Federation of Luxembourg Railway and Transport Workers and Civil Servants (Fédération nationale des cheminots, travailleurs du transport, fonctionnaires et employés du Luxembourg, FNCTTFEL).

According to the unions, the new agreement provides for substantial improvement for bus drivers, as follows:

  • drivers who hitherto had an 11-hour working day were paid only for hours actually worked. However, if they had a 12-hour working day, they were paid for eight hours' work. In future, bus drivers with an 11-hour day will receive pay for a minimum of seven hours' work;

  • where drivers currently have a working day of one to six hours, working time will be automatically increased by one hour from 1 September 2002;

  • in all cases, monthly pay will be calculated on the basis of a minimum of 173 hours; and

  • a number of improvements have been made to bonuses payable when the 11- or 12-hour working day is exceeded.
